Health authority finally ordered to pay damages following negligence during boy’s birth eleven years ago

A boy with cerebral palsy and learning difficulties has been awarded 1.5 million pounds by Gloucester Crown Court following a successful attempt on the part of his parents to sue South Staffordshire health authority for negligence. Sebastian Sargent is now 11 and it has taken 9 years to bring the action to fruition. His father is adamant it has been worth the wait, saying, ‘It is a great relief that it goes some way to securing his future for when his mother and I have gone.‘ It is likely that the couple will use the money to build Sebastian self contained housing next to their own home.

Sebastian’s condition has been attributed to the fact that, during his birth, Stafford General Hospital were too slow to take the decision to perform an emergency Caesarian operation. His parents also believe that Sebastian was ’over ventilated’ at Stoke on Trent hospital where he was taken subsequently intend to make this the subject of further legal action.
